Terms of Service

1. Who we are

Affiliateler ("the Service", "we", "us", "our") is operated by ARIF AI SOLUTIONS, a business registered in Malaysia under the Registration of Businesses Act 1956 (registration no. 202603054291 / MA0343011-X). By creating an account or using the Service, you ("you", "your") agree to these Terms of Service. If you do not agree, do not use the Service. Contact: arifin@arifaisolutions.com.

2. The Service

Affiliateler is an AI-powered tool that generates marketing content (creative angles and platform-ready copy, and optional images) for products you intend to promote as a Shopee affiliate. It produces draft content for your review; it does not publish content on your behalf.

3. Eligibility & accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You agree to provide accurate account information and are responsible for activity under your account. Authentication is handled by our provider, Clerk; keep your login credentials secure.

4. Credits & payment

The Service is offered as a prepaid, non-subscription campaign-credit pack (currently RM39 for 16 campaign generations). Credits do not expire. Payments are processed by Stripe; we do not store your card details. Purchases are subject to our Refund Policy.

5. Acceptable use

You are solely responsible for how you use content generated by the Service. You agree to comply with: (a) the Shopee Affiliate Programme terms and Shopee's policies; (b) the rules and terms of any platform where you publish (including TikTok, Facebook, Threads, and WhatsApp); and (c) all applicable Malaysian laws, including advertising, consumer-protection, and e-commerce regulations. You must not use the Service for unlawful, deceptive, infringing, or harmful purposes, or to generate content that misrepresents a product. You must not resell, sublicense, or attempt to disrupt the Service.

6. AI-generated content

Content is produced by AI models and may be inaccurate, generic, outdated, or unsuitable. You must review, verify, and edit all generated content before publishing it. You are responsible for the final content you publish and any claims it makes.

7. No guarantee of results

We do not guarantee any particular outcome from using the Service, including sales, clicks, engagement, audience growth, or affiliate commissions.

8. Intellectual property & material you upload

As between you and us, you own the content you generate using the Service and may use it for your affiliate marketing. We own the Service itself — the software, design, and underlying systems — and these Terms grant you no rights to them beyond using the Service as intended.

The Service works from material you provide — for example, product screenshots and images you upload. You represent and warrant that you own or have the necessary rights to the material you upload, and that uploading it and having us process it does not infringe any third party's intellectual-property, privacy, or other rights. You grant us a limited, non-exclusive licence to store and process your uploaded material solely to provide the Service to you (such as extracting product details and generating content). You are solely responsible for the material you upload and agree to indemnify us against any claim arising from material you were not entitled to upload.

9. Availability

The Service is provided "as is" and "as available". We may modify, suspend, or discontinue features at any time, and the Service may experience downtime.

10. Limitation of liability

To the maximum extent permitted by Malaysian law, our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential losses, including lost profits, lost sales, or lost data. Nothing in these Terms excludes liability that cannot be excluded under Malaysian law.

11. Termination

We may suspend or terminate your access if you breach these Terms or use the Service unlawfully. You may stop using the Service at any time and delete your account from your Account page.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest version. Your continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Malaysia, and you submit to the non-exclusive jurisdiction of the Malaysian courts.
